Conclusion of the Contract

To place the order you must follow the online purchase procedure and click on “Authorize Payment”, and first you must read and accept these General Conditions of Sale. By doing so you are entering into a purchase and sale agreement with LOOPPACK (“Agreement”). You will subsequently receive an email acknowledging receipt of the order (the “Order Confirmation”).

Placing an Order Online

To place an order online on the website www.looppack.eu it is necessary to register as a customer by filling out the online digital form. Once registered, simply insert all the items you want to purchase into the virtual shopping basket. You must follow all the purchase steps for it to be completed successfully. Furthermore, during the purchase process, before payment, the Customer can change their order details. The data recorded by LOOPPACK constitutes proof of the set of transactions carried out between LOOPPACK and the Customer. LOOPPACK archives the electronic document in which the Contract is formalized and keeps it accessible. The Contract is concluded in Portuguese.

Delivery Conditions

For orders placed by the Buyer before 10 am (local time) delivery will be made within 24 to 48 hours in mainland Portugal from Order Confirmation. For orders placed after 10am (local time) delivery will be made within 48 to 72 hours from Order Confirmation. For deliveries to Madeira or the Azores, please contact us before placing the order. Any delivery will be made on working days from Monday to Friday. In the event of delays occurring in relation to the agreed delivery times, due to causes beyond our control, there will be no right to compensation in favor of the Buyers, who will be informed of the respective delay by LOOPPACK. LOOPPACK may carry out partial deliveries which, in any case, will not involve additional cost to the buyer.

Order deliveries are made on working days.

Important: We inform you that all deliveries are made on the ground floor. Merchandise is not delivered to upper floors and is not depalletized. If you have any questions and need more information, please send us an email: geral@looppack.eu

Delivery Fees

LOOPPACK products will be delivered to mainland Portugal with postage paid for orders over €200 excluding VAT. For orders below this value, delivery costs of €9.90 excluding VAT will be charged. If the Customer requires special transport, or for orders outside mainland Portugal, the shipping costs will be borne by the Customer.

Return

LOOPPACK gives the Customer the possibility of returning a product purchased on the website without the need to indicate any reason, as long as all the conditions indicated below are met:

The Customer must communicate the intention to return the product to LOOPPACK clearly and in writing (for example by letter sent to Rua Eça de Queirós, 148 R/C Esquerdo, Fração A, 4810-006 GUIMARÃES to the complaints department, or by email to geral@looppack.eu, within a maximum period of 30 days from the date of receipt of the product and, within the same period, send the complete product with postage paid by the Customer, with all its accessories, in perfect conditions of use and in its original packaging, attaching a copy of the Invoice.

In the case of products manufactured or processed in accordance with specifications provided by the Customer, their return or exchange is not permitted, unless proven non-conformity between the product supplied and the product ordered.

Failure to comply with the conditions indicated above will result in refusal to accept the return.

In the event of a return made in compliance with the above conditions, the Customer will be refunded the value of the product within a maximum period of 15 days from LOOPPACK’s receipt of the returned product. LOOPPACK will make this refund using the same payment method that the Customer used in the initial transaction, unless expressly agreed otherwise by the Customer. The Customer may alternatively choose to request a product as an exchange for what is returned, which, if available, will also take place 15 days after LOOPPACK receives the returned product.

Reservation of Property

LOOPPACK reserves ownership of the merchandise sold until full payment by the Customer.

Pricing Policy

The prices in the LOOPPACK catalogs or those included on its website www.looppack.eu do not include VAT, as they are sales aimed exclusively at companies or professionals, that is, to non-consumers, with the corresponding VAT in force being added to the invoice. Prices will remain unchanged within the catalog’s validity period and will always be linked to the conditions presented. LOOPPACK may always change prices within this validity period if there is a price increase in manufacturers’ or distributors’ price lists, new taxes or increases in existing ones or in similar situations. These changes will always be informed on the LOOPPACK website (www.looppack.eu). We draw your attention to the fact that the price applicable to the product to be purchased will always be the price indicated on the website on the date the purchase is made by the Customer. Prices published in LOOPPACK catalogs are subject to change and/or modifications due to specifications, quantities, raw materials, production costs, shipping considerations, etc. Therefore, MIGUEL MARTINS FERNANDES, UNIPESSOAL, LDA recommends that all its customers consult the website www.looppack.eu to find out, at any time, the updated prices of all our products.

Payment Methods

The accepted payment methods are: credit card, Multibanco reference, Paypal or bank transfer under the terms detailed in the link below. Due to the fact that it is not possible to indicate the total price to be paid, as the costs arising from sending the order will have to be calculated by our Commercial Department, in the case of placing an order with delivery to Madeira or the Azores, the payment method by credit card or Paypal is not enabled on our website.

On the first order placed by the Customer, payment will be made in advance, via credit card, Multibanco reference, Paypal or bank transfer. From the second request onwards, LOOPPACK may accept, upon analysis of the specific case, that payment be made within 30 days from the date of issuance of the invoice. In the case of personalized products, an advance payment of 50% will always be required.

Payment delay

If payment for the requested products is not made within the due date, LOOPPACK will request immediate payment from the Customer. Furthermore, LOOPPACK reserves the right to suspend any order in progress until payment of the amounts due is made by the Customer. LOOPPACK may demand from the Customer the corresponding bank expenses for said non-payment and initiate legal actions that it deems appropriate to recover the debt, with the Customer assuming, in this case, the cost of such actions. The Customer who is late in paying any invoice is subject to payment of default interest calculated at the legal rate for commercial operations.

Guarantee

LOOPPACK provides a commercial guarantee against manufacturing defects for a period of two years, counting from the date of delivery of the goods. The warranty covers the repair of the product (parts and services included), or its replacement with an identical product, or with equivalent functionality. Repair and replacement will be free of charge for the Customer. The warranty only covers defects that already exist on the date of delivery of the goods, therefore deficiencies caused by negligence, blows, improper use or manipulation, unsuitable voltage, incorrect installation not carried out by technicians accredited in the respective area of ​​activity when necessary, nor materials subject to wear due to normal use are not included.

The warranty will cease to be valid if the identification number is used or repaired so that it is not visible and if the Customer repairs, directly or through third parties, the device under warranty without previously informing the Technical Service via email sent to the email address below.

The customer must inform LOOPPACK of the manufacturing defect within 30 days from the moment they become aware of it and always within two years from the date of delivery.

Limitation of Liability

LOOPPACK will only be responsible for damages caused with intent or gross negligence.

Applicable Law and Competent Jurisdiction

These conditions are regulated by Portuguese Law. For the resolution of any divergences that may arise in the fulfillment or interpretation of these Conditions, the jurisdiction of the District of Lisbon West is exclusively competent, expressly renouncing any other.
